The charges that you are facing in a DUI case depend on the specifics of your arrest, and whether or not you have been convicted of DUI previously. The following outline highlights the possible punishments for a conviction on DUI charges.

First DUI Offense

This is a misdemeanor charge, and would put you on probation for three years. You would spend between two days and six months in jail, and pay a fine of up to $3,000. You can also have your drivers license suspended, and be required to attend a court approved alcohol education course.

Second DUI Offense

This is also a misdemeanor, but will carry between four days and one year in jail. You will be subject the same range of fines, but could have your driver’s license suspended for up to two years.

Third DUI Offense

Still a misdemeanor, this charge carries a minimum of four months in prison, up to one year. You will be on probation for three to five years, and face a license suspension for three years as well.

Fourth DUI Offense

This charge is a felony, and a conviction will land you in jail for between 16 months and three years. You will lose your driver’s license for four years, and possibly have to forfeit your vehicle.
